This Privacy Policy explains how ModernLift ("ModernLift", "we", "us", or "our") collects, uses, and shares information when you visit or interact with the website at modernlift.ai and its subdomains (the "Site").

Scope of this policy

This policy applies to the Site only. It is a marketing and informational website. It does not, by itself, create any service relationship between you and ModernLift. Any engagement for services, products, or deliverables is governed exclusively by a separate written agreement signed by the parties, which will control over this policy with respect to that engagement and any data handled under it.

By accessing or using the Site, you acknowledge that you have read and understood this policy. Your continued use of the Site indicates your consent to the collection and use of information as described here, to the extent permitted by applicable law.

Information we collect

We may collect the following categories of information:

  • Information you provide. When you submit a contact form, request information, subscribe to communications, or otherwise email or message us, we collect the details you choose to provide. This may include your name, business email address, company name, job title, phone number, and the contents of your message.
  • Server logs and technical data. Our servers and hosting providers automatically record information when you access the Site, including your IP address, browser type and version, operating system, referring and exit pages, the pages you view, the dates and times of access, and similar diagnostic and usage data.
  • Device and usage data. We may collect information about the device and connection you use to access the Site, along with how you interact with our pages, such as clicks, scrolling, session duration, and approximate location derived from your IP address.

We may use cookies and similar technologies to operate the Site, remember your preferences, measure and improve performance, and understand how the Site is used. Cookies may be session-based (deleted when you close your browser) or persistent (retained until they expire or you delete them), and may be set by us or by third parties acting on our behalf.

Analytics and tag management

We use Google Ads, including remarketing (also called retargeting), to promote ModernLift. Google and other third-party vendors may show our ads to you on Google and on other websites across the internet based on your prior visits to the Site. To do this, we and these vendors use cookies and similar technologies (such as Google's advertising cookies and device identifiers) to recognize returning visitors, build advertising audiences, and measure ad performance.

You can control or opt out of personalized advertising. Manage Google ad personalization at google.com/settings/ads; opt out of many third-party vendors at optout.aboutads.info (Digital Advertising Alliance) or youradchoices.com; and adjust cookie controls in your browser. Opting out limits ad personalization; it does not remove all ads.

How we use information

  • respond to your inquiries and provide the information you request;
  • communicate with you about ModernLift, including marketing and informational messages where permitted by law;
  • understand and analyze usage and trends to improve our content and offerings;

Where applicable law requires a legal basis for processing personal information, we rely on the following. We process the information you provide to us, and information we collect from public and commercial sources, on the basis of our legitimate interests in operating and growing a business: identifying organizations and professionals who may benefit from our services, conducting business-to-business outreach, sending relevant commercial communications, and maintaining and developing our business relationships. We may also process information to perform a contract or take steps at your request before entering one, to comply with our legal obligations, or with your consent where consent is required.

As part of our business development, we may collect and process limited business-contact details of professionals, such as name, employer, job title, business email address, and business phone number, obtained from you, from your employer's or your own publicly available materials, or from reputable third-party sources. We use this information to contact individuals in their professional capacity about ModernLift and how our services may be relevant to their organization. We have assessed that this processing is proportionate, that we use the minimum information necessary, and that it does not override the rights and interests of the individuals concerned.

We honor opt-out and data-subject rights for this processing. You may object to our processing of your information for outreach or marketing and ask us to stop contacting you, opt out of marketing communications by following the unsubscribe instructions in those messages, and request that we delete or correct your contact details. Where we rely on legitimate interests, you have the right to object to that processing on grounds relating to your particular situation, and we will stop unless we have compelling legitimate grounds that override your interests or the processing is needed to establish, exercise, or defend legal claims. How we share information

We do not sell your personal information. We may share information in the following circumstances:

  • Service providers and sub-processors. We may share information with third-party vendors, processors, and sub-processors who perform services on our behalf, such as hosting, email delivery, analytics, tag management, customer relationship management, and security. These parties may process information only to provide services to us.
  • Legal and safety. We may disclose information where we believe it is reasonably necessary to comply with applicable law, regulation, legal process, or a governmental request, or to protect the rights, property, or safety of ModernLift, our users, or others.
  • Business transfers. We may disclose or transfer information in connection with, or during negotiations of, a merger, acquisition, financing, reorganization, or sale of all or part of our assets.
  • With your direction. We may share information for any other purpose disclosed to you at the time we collect it, or otherwise with your consent.

Data retention

If you are a resident of California or another U.S. state with a comprehensive privacy law, you may have the right, subject to that law and its exceptions, to know or access the personal information we have collected about you, to request its correction or deletion, and to opt out of the sale or sharing of personal information and certain targeted advertising. We do not sell your personal information, and we do not share it for cross-context behavioral advertising as those terms are defined under the California Consumer Privacy Act, as amended by the California Privacy Rights Act. EEA, UK, and similar jurisdictions. If data-protection laws such as the EU or UK GDPR apply to you, you may have the right to access, correct, delete, restrict, or object to our processing of your personal information, to data portability, and, where we rely on consent, to withdraw that consent at any time without affecting prior processing. The legal bases on which we rely are described in "Legal basis and business outreach" above. You also have the right to lodge a complaint with your local supervisory authority, though we encourage you to contact us first so we can try to resolve your concern.

Data security

We use reasonable administrative, technical, and organizational measures designed to protect information against loss, misuse, and unauthorized access, disclosure, alteration, and destruction. However, no method of transmission or storage is completely secure, and we cannot guarantee the absolute security of any information.

Children's privacy

The Site is intended for businesses and professionals and is not directed to children. We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us so we can take appropriate action.

International users

ModernLift operates from and stores information in the United States. If you access the Site from outside the United States, you understand that your information may be transferred to, stored, and processed in the United States and in other countries where we or our service providers operate, which may have different data-protection rules than your jurisdiction.
